These Terms of Service (“Terms”) apply to participants (“Affiliate”) of the Perfect Privacy Affiliate Program (“Program”). By registering for the Program you accept these Terms of Service.
To participate in the Program you must apply by email as stated on our Affiliate page (https://www.perfect-privacy.com/en/vpn-affiliate-program). Affiliate Program registration requires your name, postal and email address and a minimum age of 18 to receive commissions from Perfect Privacy.
We will review your application and notify you of whether your application is accepted or denied. It is within the sole discretion of Perfect Privacy to accept or deny applications for any or no reason at all. If we reject your application, Perfect Privacy shall owe no duties or obligations to you.
In order to participate in our Affiliate Program you must have one or more website(s) from where you can link to the Perfect Privacy website. Websites relevant to the topics “Security”, “Privacy” and “Anonymity” are preferred. It is within the sole discretion of Perfect Privacy to decide whether your website meets our requirements.
Once your application has been accepted, you will receive your personal referral ID in the affiliate panel. The referral ID must be used exactly as provided for linking to the Perfect Privacy website. Failure to comply with this will result in you receiving no credit for sales that are generated through your website.
We also can provide you with materials for linking to our site. Any other material you want to use to link to our site must be approved by Perfect Privacy before being displayed on your website. You may display, on your site only, such names, trademarks or advertising materials as Perfect Privacy may make available to you, or as we may approve in writing (“Ads”). You may not use Perfect Privacy’s trade names and trademarks other than the Ads. Specifically, you may NOT use the Ads in a manner that
(i) implies or suggests that your site was established or is maintained by Perfect Privacy
(ii) states or implies that you are an authorized representative of Perfect Privacy or advertising with the word “official”
(iii) does mislead others
(iv) violate Google’s AdWord policies
No affiliate shall bid on any online advertising systems (such as Google Adwords, etc.) for the following keywords and any variation or misspelling: “Perfect Privacy”, “PP”, “TrackStop”.
We reserve the right to require that you stop displaying or using any link or ad on your site, that, in our sole and absolute discretion, is inconsistent with these terms.
Full report of all sales generated through your affiliate links will be available on your affiliate dashboard. We reserve the right to alter the form and content of such reports without prior notice.
You will receive the commission rates per email once your application for participation in the Program has been approved. We may change these rates and our prices at any time without notice.
In order for a referral to successfully track to an affiliate the customer must sign up after clicking through a valid affiliate link and have cookies enabled so the tracking will work properly. If any sale does not track to an affiliate account no commission will be earned. Perfect Privacy is in no way liable for any issues that result in a referral not tracking to your account.
We shall send payment to you using the payment method you have selected in your affiliate dashboard. If no payment method is selected, we shall not be under any obligation to make payments to you. Our only liability is to send payment using the details provided by you and we shall have no liability for lost payments as a result of details being incorrectly entered by you.
Payments will be sent after receiving manual request from you which can be made from the affiliate dashboard, subject to your balance being above the minimum payment threshold.
The minimum payment threshold is 100 EUR for PayPal and Bitcoin. No payment will be made unless your balance exceeds this amount.
Before any payments are sent we reserve the right to review any and all commissions earned by any affiliate. In the event that it is found, in our sole discretion, that an affiliate is in breach of these Terms, we have no obligation to pay you for commissions earned while in breach of these Terms.
In the event of any chargebacks, refunds or cancellations by customers referred by you, your commission shall be cancelled. If we have already paid the relevant commission to you, we shall deduct that amount from our next payment to you. Refunds will be made to customers in accordance with our refund policy or at our sole discretion.
All personally identifiable information, if any, provided by end users visiting the Perfect Privacy website and/or any or all reports, results, and/or information created, compiled, analyzed and/or derived by Perfect Privacy from such data is the sole and exclusive property of Perfect Privacy.
In order to receive commissions, you must provide Perfect Privacy with all the information requested, which may include personal and/or business name (if applicable), your address and the respective payment information. You understand that it is your responsibility to notify and inform Perfect Privacy regarding any changes to any information relevant to these Terms.
You agree that all information including, without limitation, the Terms of this agreement, business and financial information, and pricing and sales information, shall remain strictly confidential and shall not be utilized for any purpose outside the Terms of this agreement except and solely to the extent that any such information is
(i) already lawfully known to or independently developed by the receiving party
(ii) disclosed in published materials
(iii) generally known to the public
(iv) lawfully obtained from any third party any obligation of confidentiality to the discloser hereunder
The Affiliate understands that they will act with due diligence to prevent a disclosure of confidential information.
Unless otherwise expressly indicated, we are the sole and exclusive owners of all intellectual property rights on our site, including but not limited to, all code, text, sound, video, graphics, photographs and other images that form a part of the site. We shall be the sole and exclusive owners of all intellectual property rights which may exist in all future updates, additions and alterations to our site.
By admitting you into the Affiliate Program, Perfect Privacy grants you a limited, personal, nontransferable, non-sublicensable, revocable license to use Perfect Privacy’s names, trademarks, and images comprising or contained in any Ads or graphics supplied by Perfect Privacy solely for the purpose of displaying the Ads on your site in accordance with these Terms. You may not modify any name, image, trademark, message, embedded programming or any of our graphics provided to you by Perfect Privacy in any way.
The development, operation and maintenance of your website(s) is solely your responsibility. This includes, but is not limited to:
(i) the technical operation of your site and all related equipment
(ii) the accuracy and appropriateness of materials posted on your site
(iii) ensuring that materials posted on your site do not violate or infringe upon the rights of any third party (including, but not limited to, copyrights, trademarks, privacy or other personal or proprietary rights)
(iv) ensuring that the link to the the Perfect Privacy website from your site is in the format specified by us
(v) ensuring that materials posted on your site are not libelous or otherwise illegal
You agree that you will not make any representations, promises, warranties or other statements about Perfect Privacy or the Perfect Privacy website, products or policies other than as may be expressly approved in writing by Perfect Privacy or as otherwise provided to you by Perfect Privacy for that purpose.
You and Perfect Privacy shall act as independent contractors and shall have no authority to obligate or bind the other in any respect. Nothing in these Terms will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties. You will have no authority to make or accept any offers or representations on Perfect Privacy’s behalf. You will not make any statement, whether on your site or otherwise, that reasonably would contradict anything in this section.
The provisions of these Terms are independent of and separable from each other, and no provision shall be affected or rendered invalid or unenforceable by virtue of the fact that for any reason any other or others of them may be invalid or unenforceable in whole or in part.
We reserve the right to change these terms of service with or without prior notification. The most recent Terms of Service will always be located on this page and will supersede any previous version. Your continued use of this affiliate program constitutes your agreement to these Terms of Service and any revisions. Should you not agree to any change in these Terms of Service you should cancel your affiliate account immediately.
